PRIVACY POLICY/NOTICE AT COLLECTION

Your privacy is respected by The Becker Group, Inc. We have created this combined Privacy Policy and Notice at Collection to demonstrate our firm commitment to privacy and security, and to comply with the California Consumer Privacy Act of 2018 and California Privacy Rights Act of 2020 (“CCPA/CPRA”) as well as subsequent amendments.
All terms defined in the CCPA/CPRA have the same meaning when used in this Policy and Notice.
During any engagement with us, we may ask you to provide personal information such as your name, email address, mailing address, phone number, etc. The personal information we collect during this process is used for typical business purposes only.
We do not sell or share any personal information. We are therefore also compliant with Nevada’s state privacy laws of 2017 and 2019 (NRS 603A.300-603A.360 and SB-220).
Although we take care to safeguard and secure all personal information, please be aware that information sent via email can be intercepted by third parties. If you are sending particularly sensitive information by email, you should encrypt or encapsulate it within a password protected file and then contact us separately with the relevant password.
California Notice at Collection
This Notice at Collection supplements the information contained in The Becker Group Privacy Policy and applies to natural persons residing in the state of California.
This Notice informs consumers who are California residents (“you”), at or before the time of collecting their personal information, about the categories of personal information that we collect from them and the purposes for which those categories of personal information may be used.
This Notice also provides you with a description of our practices regarding the collection, use, and disclosure of personal information, and explains your rights regarding your personal information under the CCPA/CPRA.
Categories of personal information we collect and how we use them
We collect personal information in order to manage properties for owner/landlords and to rent properties to tenants, and are legally required to do so.
“Personal information” means information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident, household, and/or device (e.g., desktop or laptop computer).
Please note that the following are NOT considered “Personal information” in California law:
- Publicly available information from government records
- De-identified or aggregated consumer information
- Information explicitly excluded from the CCPA’s scope, including personal information covered by the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994
We collect the following categories of personal information:
In the past 12 months, we have NOT collected the following categories of personal information:
- Biometric information (Cal. Civ. Code 1798.140 (v)(1)(E))
- Internet or other similar network activity, such as browsing history, search history, information about consumers’ interaction with a website or advertisement (Cal. Civ. Code 1798.140 (v)(1)(F))
- Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99) (Cal. Civ. Code 1798.140 (v)(1)(J))
- Inferences drawn from any other category of personal information to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes (Cal. Civ. Code 1798.140 (v)(1)(K))
Sources of personal information
We receive personal information primarily from consumers themselves (or from other individuals acting on their behalf), via physical and online correspondence, submitted forms, and phone and in-person conversation. We may also receive some personal information from other sources, including:
- Real estate brokerages, brokers, and agents
- Credit reporting agencies
- Vendors, contractors, and inspectors
Selling or sharing personal information
We do NOT sell or share any personal information.
We do NOT use or disclose sensitive personal information for purposes other than those specified in the CCPA Regulations, Title 11, Div. 6, Ch. 1, Art. 3, section 7027, subsection (m).
Disclosure of personal information to service providers
We use external companies or organizations (“service providers”) that provide activities such as credit reporting, fraud prevention, and underwriting. In order to facilitate our services and maintain our business, we may disclose personal information to these service providers, as well as our legal representatives.

According to the definitions provided in the CPRA (Cal. Civ. Code § 1798.140 (ad) and (ah)), the disclosure of consumers’ personal information to service providers for our business purposes does not constitute ‘sharing’.
Our contracts with service providers prohibit them from retaining, using, or disclosing consumers’ personal information, other than for our specific business purposes.
Retention of personal information
We retain each category of personal information as long as needed to accomplish the business or commercial purposes for which the information is collected, and only as long as required to comply with regulatory and legal requirements.
Your rights under the CCPA/CPRA
Under the CCPA/CPRA, you have the right to submit to us a maximum of 2 consumer rights requests regarding your personal information in any 12-month period, as follows:
a) If you are a California resident, you have the right to request that we provide disclosures about, or access (in a portable form) to, the following information:
- The categories of personal information that we have collected about you since January 1, 2022
- The categories of sources from which your personal information was collected since January 1, 2022
- The categories of third parties to whom we have disclosed your personal information since January 1, 2022, and the categories of personal information disclosed
- The business or commercial purposes for which we collected your personal information since January 1, 2022
- Specific pieces of personal information that we have collected about you since January 1, 2022
b) If you are a California resident, you have the right to request the following:
- The correction of inaccurate personal information that we have collected about
- The deletion of specific pieces of personal information that we have collected about you
- The deletion of all personal information that we have collected about you
c) If you are a California resident, you have the right not to receive discriminatory treatment for the exercise of the rights conferred upon you by the CCPA/CPRA, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of these rights.
How to exercise your CCPA/CPRA rights
You or your authorized representative may make a request for disclosure, access, correction, and/or deletion in the following ways:

How we will process CCPA/CPRA requests
Any information you submit via this form will only be used to verify your request and will be processed in accordance with CCPA/CPRA regulations. We will confirm receipt of your request within 10 days, together with an overview of how your request will be processed and when you can expect a decision from us.
We may ask for further information from you for the purposes of verification, especially if your request relates to sensitive personal information. If you are making the request on behalf of a California resident, this form must be accompanied by their written authorization showing that they have granted you the authority to submit a consumer rights request on their behalf. We may also contact the person you represent in order to verify their identity and to confirm your authority to act on their behalf.
If we are still unable to verify your identity (or the identity of the person you represent), and are therefore unable to confirm that the personal information relates to you (or the person you represent), we will deny your request and explain why.
We will communicate our decision to grant, partially grant, or deny your request within 45 calendar days of its submission. If we grant your request, we will also aim to comply with it within 45 calendar days of its submission.
If we are unable to comply with your request within 45 calendar days due to logistical reasons, we reserve the right to extend that deadline to 90 calendar days, in which case we will inform you of the extended deadline and its cause by the 45th calendar day following submission.
If we deny your request, we will explain why (unless prohibited from doing so by law).
We will keep a record of your request and our response for 2 years, as required by the CCPA Regulations, Title 11, Div. 6, Ch. 1, Art. 8, section 7101, subsection (a).
